The regular meeting of the Town of Pines Town Council was called to order at 6:30 p.m.
In attendance were: Cathi Murray, George Adey, Vicki Kuzio, Alan Murray and Sandra Hall. Cathi led us in the Pledge of Allegiance to the Flag.
Vicki Kuzio made a motion to change the order of business, George seconded the motion and the motion was voted on and passed 3-0. Bob Gerometta gave a brief review of what happened at the Bid opening on February 23, 2011. Sandra was instructed to take the bids to our Town Attorney for review. Sandra and Bob met with Mr. Chuck Lukmann on February 24, 2011 and left a copy of each of the lowest bids with him to review. The results of the bidding is as follows:
George made a motion to award the bid to the next lowest bidder Hamstra Builders, Inc we specifically find that Innovative Construction Services, Inc. was not a responsive bidder in accordance with I.C. 36-1-12-4(b)(10)(B) and (C). Specifically, the 5th paragraph of the Notice to Bidder states “[b]ids shall be properly executed, submitted on a current State Board of Accounts Form 96, including financial data as recent as possible, a non-collusion Affidavit…”. Innovative is non-responsive to the Notice of Bidders as it failed to execute the non-collusion affidavit and the bid itself. It is non-responsive to I.C. 36-1-12-4(b)(10)(C) as I.C. 36-1-12-3.5-(12) requires the bidder to submit a non-collusion affidavit, which Innovative failed to do by not executing the non-collusion affidavit. The Town of Pines Town Council will release the bid bonds of all unsuccessful bidders. Vicki seconded the motion and the motion was voted on and passed 3-0.
Hamstra Builders, Inc. has 2 weeks to send Performance Bond and Labor & Material Payment Bond, AIA Form A312, Subcontractor’s Materialman List, Insurance Certificates, Executed “Owner-Contractor” Agreement, AIA-A101, 1987 and the Schedule of Values. Work will start anywhere from end of March to the Beginning of April. Next, the Council decided on the alternate bids. George made a motion to accept GC-1 and GC-5. Vicki seconded the motion and the motion was voted on and passed 3-0.
GC-1 If Synthetic Stone Veneer (Spec. Section 4600) is used in lieu of Base Bid Rock Faced CMU Veneer: (Spec. Section 4300) where shown on drawing Elevations). This adds $5,265.00 to base bid.
GC-5 If ½” exterior grade CDX plywood is used for exterior wall sheathing Behind siding and/or masonry veneer in lieu of Base Bid ½” thick CDX Dow Styrofoam SIS Structural Insulated Sheathing (Spec. Section 6, para ‘L’). This deducts $400.00 from base bid.
George made a motion to accept the January 26, 2011 meeting minutes and the February 23, 2011 bid opening minutes and Vicki seconded the motion and the motion was voted on and passed 3-0. (With changes to the February 23, 2011 bid opening minutes as follows: the Town Council instructed Sandra to take the lowest bids to our Town Attorney, for review, tomorrow.)
Clerk-Treasurer Sandra read the funds received.
Building and Zoning Administrator No permits issued this month.
Alan and George met with the prevailing wage committee. Porter Bank fixed their sign. Mr. Dobkins neighbor is happy with the clean-up except the Tractor and Pickup still in the yard. Alan is to send Mr. Dobkins a letter to remove the pickup and Tractor or the Council will fine him. George made a motion for Alan to send the letter and Vicki seconded the motion and the motion was voted on and passed 3-0.
Alan and George met with Mr. Tom Frailey of the Foundation for Fair Contracting. Mr. Frailey wants the Council’s permission to work directly with Alan on the construction site. They will report any concerns to Alan about safety or payroll issues during this project. George made a motion to allow the Foundation for Fair Contracting to work directly with Alan on this project and Vicki seconded the motion and the motion was voted on and passed 3-0.
Street Department Light has been fixed under viaduct on Railroad Ave. Michigan City school bus drivers had made a complaint to the Town about the very bad icy conditions of our roads especially at the intersections and hills. Vicki instructed our workers to use more salt on these areas. Ardendale and Railroad Ave is very bad and needs repair as soon as the weather permits.
The “No Overnight Parking” sign is in and will be put up as soon as the ground thaws.
Trees are gone at the sledding hill at the Birch Street Park , stumps will be removed soon.
Vicki and Dan will look into fencing at the Birch Street Park to keep people from driving into the grass area.
Old Business Cathi presented the Council with an ordinance prepared by attorney Chuck Parkinson regarding flood hazard. Cathi passed the gavel to George Adey then made a motion to pass Ordinance 2011-03-03, An Ordinance of the Pines Town Council Amending chapter
4 of the Pines Town Code by Adopting Regulations for Flood Hazard Areas, on the first reading. Vicki seconded the motion and the motion was voted on and passed 3-0.
Then, Cathi made a motion to passed Ordinance No. 2011-03-03 and Vicki seconded the motion and the motion was voted on and passed 3-0. Sandra will send this ordinance and the intent to participate ordinance to the Indiana Department of Natural Resources Division of Water.
New Business George Adey will be checking with Beverly Shores about hiring them to patrol in the Town of Pines .
George made a motion to pay the claims and Vicki seconded the motion and the motion was voted on and passed 3-0.
